“Seller”, “we” and “us” mean Avionics Support Sales Limited, registered in England and Wales under company number 09418864, whose address for notices is Unit 3 The Rutherford Centre, Rutherford Way, Crawley, England, RH10 9RU. “Buyer” and “you” mean the person or organisation placing an order. “Goods” means the aircraft parts and other products specified in our accepted order. “Website” means our e-commerce site at avionicssupport.com/store. “Business Buyer” means a person buying wholly or mainly for business purposes; “Consumer” means an individual acting wholly or mainly outside their trade, business, craft or profession.
These Conditions govern orders placed through the Website and other orders accepted by us, unless separately agreed written account terms expressly prevail. Mandatory rights under applicable law are not excluded. In case of inconsistency, an individually agreed written contract prevails, then the accepted order confirmation, then these Conditions.
Product descriptions, prices, availability, lead times, certification and images on the Website are invitations to place an order, not binding offers. We take reasonable care with information but may correct genuine errors before accepting an order. We will contact you where a material change requires your agreement; we will not impose an increased price after acceptance without your agreement.
Buyers must verify part numbers, interchangeability, condition, documentation, shelf life and suitability for the intended aircraft, installation and regulatory jurisdiction. Nothing in this clause limits a Consumer’s statutory rights or our liability for inaccurate descriptions or other matters which cannot lawfully be excluded.
Goods may be supplied as new, new surplus, serviceable, repaired, overhauled or other condition only as expressly described in the accepted order. Release documentation or traceability is supplied only as specified in the listing or confirmation. No listing is a representation that an item is approved for installation in every aircraft or jurisdiction.
By clicking the order/payment button you submit an offer to buy the selected Goods and agree to these Conditions. Before placing an order, the Website will display the products, quantities, total price, applicable taxes, delivery charges and any other mandatory costs, and provide an opportunity to correct input errors.
The automatic checkout email and any Judo Pay payment receipt acknowledge submission and payment only; neither is acceptance of the order. A binding contract is formed only when we issue a separate order acceptance/order confirmation from Quantum expressly confirming acceptance, or when we dispatch the Goods, whichever occurs first. A tax invoice is not, by itself, acceptance unless expressly identified as the order acceptance.
We may decline an order before acceptance for genuine stock, pricing, sanctions/export-control, payment-security or fulfilment reasons. If payment has already been captured, we will refund it promptly using the original payment method; where only authorised, we will release the authorisation promptly. We will notify you if an order cannot be accepted.
Before acceptance, Buyers may request withdrawal of an order; we will use reasonable efforts to stop processing and refund any captured payment. For Business Buyers, once an order is accepted, cancellation or reduction requires our written agreement, which may be subject to reasonable, evidenced, unrecoverable costs and any agreed restocking charge disclosed before the cancellation is agreed. No automatic full indemnity applies regardless of actual loss.
Consumers retain the statutory cancellation rights set out in clause 14. Nothing in this clause restricts remedies for breach, faulty Goods, misdescription or other non-excludable rights.
For Consumer sales, prices presented to Consumers must include VAT and other mandatory taxes where applicable. For Business Buyers, prices may be displayed exclusive of VAT only where clearly identified as such; VAT and all compulsory charges must be shown before the final payment button. The full amount payable, including delivery, will be displayed at checkout.
International Buyers may be liable for import VAT, customs duty, brokerage and other destination-country charges where disclosed and consistent with the agreed delivery terms. We will identify any delivery terms (including Incoterms® 2020, if used) in the order confirmation.
All Website orders are payable in full in advance at checkout using the payment methods made available through Judo Pay (our payment services provider). Payment is subject to authorisation and fraud/security checks. We will not dispatch Goods until payment has been successfully captured and the order accepted. A payment acknowledgement or receipt is sent electronically as part of checkout; a VAT invoice will be issued where required by law and/or as part of the Quantum order documentation.
Card details are handled through the payment integration and payment processor as explained in our Privacy Policy. We do not require Buyers to send payment card details by email.
Only customers expressly approved for a separate credit account may use invoiced credit terms. Their payment deadline is the deadline agreed in their written account terms; absent such agreement, full payment is due before dispatch. Late-payment interest and recovery costs for qualifying business debts may be claimed to the extent permitted by law.
Available shipping methods, territories, delivery charges and estimated delivery times will be shown before checkout and confirmed in the accepted order. Estimates are not guaranteed dates unless expressly agreed. We will inform Buyers of material delays and their available rights.
For Consumers, unless a different period is agreed, delivery will be made without undue delay and no later than 30 days after contract formation; Consumers retain statutory rights if delivery is late or does not occur. For Business Buyers, delivery times are estimates unless expressly agreed as binding.
Dangerous goods, lithium batteries, chemicals, pressurised articles and other regulated products may be subject to carrier restrictions, special packaging, additional charges or non-availability for certain destinations. We may contact you for a compliant alternative or decline the order before acceptance; after acceptance, any material change requires agreement or a lawful cancellation/refund.
For Business Buyers, partial deliveries are permitted only where agreed or reasonably necessary and without additional unagreed charges. Business Buyers should inspect promptly and report transit damage or discrepancies as soon as practicable; this does not extinguish rights for latent defects or breach.
For Consumers, risk passes when the Goods come into the physical possession of the Consumer or a person identified by them to take possession, except where the Consumer independently commissions a carrier not offered by us, in which case applicable statutory rules govern.
For Business Buyers, risk passes at the point expressly stated in the accepted order or agreed Incoterm; otherwise on physical delivery to the specified destination. For collection orders, risk passes when collected by the Buyer or its authorised carrier. Title passes only after we receive full cleared payment for the relevant Goods, subject to applicable law.
Goods will correspond with the accepted description and any expressly agreed specification. Any manufacturer, repair-station or other third-party warranty is passed on to the extent transferable and specified. No additional warranty is implied merely by the supply of a third-party warranty.
For Business Buyers, to the fullest extent permitted by law, we exclude implied terms only insofar as it is lawful and reasonable to do so. Claims should be notified promptly with the order number, part number, photographs and available evidence; failure to meet a short notification window alone does not automatically extinguish valid claims. We may inspect, repair, replace or refund where legally and contractually appropriate.
Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded. Consumers retain all rights under the Consumer Rights Act 2015 and other applicable law; no remedy is restricted to repair, replacement or refund where the law provides more.
For Business Buyers only, subject to the preceding paragraph, our aggregate liability arising from an order is limited to the price paid for the Goods in the affected order; we are not liable for indirect or consequential loss, loss of profit or loss of business to the extent lawfully excludable. This clause must be assessed for reasonableness in the context of aviation parts and the parties’ insurance.
Neither party is responsible for failure or delay caused by events beyond its reasonable control, including natural disasters, major transport disruption, government restrictions, lawful export restrictions and major supplier disruption, provided it takes reasonable steps to mitigate and informs the other party. Payment obligations already due are not automatically suspended. Consumer rights to timely delivery, termination and refunds remain unaffected.
Website text, photographs, product databases, logos and other content are owned by or licensed to us and may not be copied or commercially reused without permission, except as permitted by law. A Buyer providing drawings or specifications confirms it has the rights needed for us to fulfil the order and indemnifies us against third-party intellectual-property claims to the extent caused by those materials, subject to applicable law.
We may screen transactions for fraud, sanctions, export-control or other legal compliance. We may request reasonable verification before acceptance and may refuse an order where required by law or where there are objectively reasonable compliance concerns. We will handle any payment already taken as described in clause 3.
After acceptance, either party may exercise termination rights available under applicable law or these Conditions. For Business Buyers, we may suspend unperformed obligations or terminate for material breach not remedied within a reasonable notified period, insolvency events where lawful, or a legal prohibition on supply. Any refund or other remedy is subject to applicable law and the circumstances.
Buyers must provide accurate end-user, end-use and destination information reasonably requested. Supply may be subject to UK export controls, sanctions, customs rules and relevant destination-country requirements; we will not fulfil any transaction prohibited by applicable law. No Buyer may divert Goods in breach of applicable controls.
Any references to aviation authorities include, as applicable, the UK Civil Aviation Authority (CAA), European Union Aviation Safety Agency (EASA), US Federal Aviation Administration (FAA) and other competent authorities. Buyers are responsible for confirming that the supplied condition, certification and traceability are appropriate for their intended installation and jurisdiction; we remain responsible for descriptions and obligations we expressly undertake.
International delivery terms, responsibility for customs clearance, duties and carriage insurance will be specified in the accepted order. No default “FOB airport” term applies to all online orders.
Where the Buyer is a Consumer and the transaction is a distance contract to which the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply, the Consumer generally has 14 days after receiving the Goods to cancel without giving a reason. For multiple Goods delivered separately, the period generally runs from receipt of the last item. Exceptions may apply, including Goods made to the Consumer’s specifications or clearly personalised; an exception is not created merely because we procure an ordinary stock item specially.
To cancel, notify us by a clear statement to sales@avionicssupport.com or Unit 3 The Rutherford Centre, Rutherford Way, Crawley, England, RH10 9RU before the cancellation period expires. We will acknowledge cancellation where required.
Unless we offer collection or are legally responsible for the return cost, the Consumer must send Goods back within 14 days after telling us of cancellation and bears the direct return cost only where we have provided the legally required information. We will refund the price and standard outbound delivery charge (not any additional premium-delivery upgrade), using the original payment method without undue delay and within 14 days of being informed of cancellation; for Goods we may withhold the refund until receipt of the Goods or evidence of return, whichever is earlier, where permitted by law.
The Consumer may handle Goods as necessary to establish their nature, characteristics and functioning. We may make a lawful deduction for diminished value caused by handling beyond that necessary, only where the legal conditions are met. Cancellation rights are separate from rights relating to faulty or misdescribed Goods.
Contact sales@avionicssupport.com with the order number, part number, reason for return and supporting photographs or documentation. We will provide return instructions and, where appropriate, a return merchandise authorisation (RMA) number. An RMA facilitates tracking and does not override statutory rights or make a valid consumer cancellation ineffective.
For Business Buyers, discretionary returns of correctly supplied Goods require prior written approval and may be refused for special-order, custom, time-sensitive, traceability-sensitive or non-resalable items. Any agreed restocking charge and return freight allocation will be confirmed before approval. Faulty, misdescribed or incorrectly supplied Goods will be dealt with in accordance with the contract and applicable law.
Please return components in secure, appropriate packaging with accompanying documents and traceability records where available; hazardous materials must not be returned without agreed compliant arrangements. Refunds of online payments will ordinarily be made through Judo Pay to the original payment method, subject to the payment provider’s processing times.
We process customer, delivery, contact and transaction data to administer orders, process payments, prevent fraud, meet legal obligations and provide customer support, as described in our separate Privacy Policy at https://avionicssupport.com/store/privacy. Our processing is subject to applicable UK data protection law, including the UK GDPR and Data Protection Act 2018.
Judo Pay and other payment or fraud-prevention providers may process payment information in their respective roles. Our Privacy Policy must accurately identify controllers/processors, purposes, lawful bases, recipients, international transfers where applicable, retention periods and data-subject rights. Non-essential cookies and similar technologies will be used only with the consent required by applicable law; see our Cookie Policy at https://avionicssupport.com/store/cookies.
Electronic order records and notices may be used for Website transactions. We may update these Conditions prospectively by posting revised terms; the version applicable to an order is the version presented when that order was placed unless otherwise lawfully agreed.
If any provision is unenforceable, the remaining provisions remain effective. No failure to enforce a right is a waiver of it. English law governs these Conditions, but Consumers retain any mandatory protections of the law applicable to them. Courts’ jurisdiction is subject to mandatory consumer-jurisdiction rules; Business Buyers submit to the exclusive jurisdiction of the courts of England and Wales.
